Terms of service

These Terms of Service ("Terms") govern your use of NowServingEarth.com (the "Site") and purchases from Alien Industrial Solutions, doing business as NowServingEarth and Alien Fab Lab, of Idaho Falls, Idaho ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

  • You must be at least 18 years old and able to enter into a binding contract to buy from us. If you buy for a company or organization, you confirm that you are authorized to bind it to these Terms.
  • You agree to use the Site only for lawful purposes. You may not misuse the Site, interfere with its operation, attempt to gain unauthorized access to it, or use it to send harmful code or spam.
  • You are responsible for keeping any account login details confidential and for activity under your account.
  • We may change, suspend or discontinue any part of the Site at any time.

2. Product information and pricing errors

  • We try to describe products accurately. Specifications, images and documents often come from manufacturers and may change without notice. Images may show options or accessories that are not included. Your quote or order confirmation states what is included in your order.
  • Manufacturer terms: A manufacturer's own terms, warranty or policies may also apply to its products. Where provided, they appear on that brand's or product's page on the Site and apply alongside these Terms. Where they conflict: for warranty, product use, safety and maintenance, the manufacturer's terms on that product's page take precedence; for payment, shipping (FOB origin), returns and refunds, quotes and order acceptance, these Terms and our store policies take precedence.
  • Prices are in U.S. dollars and may change at any time before you place your order. Applicable taxes, shipping and freight are added as shown at checkout or on your quote.
  • If a product is listed with an incorrect price or description because of a typographical, pricing or system error, we may refuse or cancel any order for that product, even after it has been confirmed. If we cancel, we will refund any amount you paid for it.

3. Quotes and orders

  • Quoted machines: Machines and systems may be sold through a written quote. Each quote sets out the price, configuration, freight, deposit, payment schedule and cancellation terms for that order. The remaining balance must be paid in full, or approved financing must be agreed upon and funded, before the machine ships. Quotes are valid for 30 days unless the quote says otherwise. If a quote and these Terms conflict, the quote controls for that order, except that payment in full (or funded financing) is always required before shipment.
  • Online orders: Your order is an offer to buy. We accept your order when we ship it or confirm it in writing. We may decline or cancel any order, including for product availability, suspected fraud, errors, or shipping restrictions. If we cancel, we will refund any amount you paid for the cancelled items.
  • We may limit quantities per order or per customer.

4. Payment

  • No order ships until it is paid. Full payment, or approved financing that has been agreed upon and funded, is required before any order ships.
  • Payment for online orders is due at checkout. For quoted machines, any deposit is due as stated in the quote, and the remaining balance is due in full (or financing funded) before shipment.
  • You confirm that you are authorized to use the payment method you provide. We may hold or cancel an order if payment cannot be verified or is declined.

5. Shipping and risk of loss

Orders ship only after full payment, or approved financing that has been agreed upon and funded. All shipments are FOB shipping point (origin). Title and risk of loss pass to you when the carrier picks up your order at our shipping point or the manufacturer's. Claims for damage or loss in transit are filed by you with the carrier, and we will help with documentation. Please note any damage on the freight bill or delivery receipt before signing, and report damage to us within 48 hours of delivery. Other shipping and delivery details are covered by our Shipping Policy, which is part of these Terms. Delivery times are estimates.

6. Returns and refunds

Returns, cancellations and refunds are covered by our Refund & Returns Policy, which is part of these Terms.

7. Warranty and disclaimer

  • Products are covered only by the manufacturer's warranty for that brand, or as stated in your quote. We do not provide a separate warranty of our own. We will help you work with the manufacturer on warranty claims.
  • Beyond the manufacturer's warranty, products and the Site are provided "as is" and "as available," to the fullest extent permitted by law. To that extent, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  • We do not guarantee that any product will meet your particular production, material, cutting, welding or engraving requirements. It is your responsibility to confirm that a product suits your intended use before you buy.
  • Some states do not allow certain warranty exclusions, so some of the above may not apply to you.

8. Safety notice

Laser, CNC and related industrial equipment can cause serious injury, eye damage, burns, fire or death if used improperly. This equipment must be installed, operated and maintained only by trained operators who follow the manufacturer's safety instructions, manuals and warnings, and all applicable laws, codes and workplace safety rules. This includes appropriate laser safety eyewear and other protective equipment, ventilation and fume extraction, fire prevention, electrical requirements, and any required guarding, interlocks, signage and registration. You are responsible for safe installation, operation, training, maintenance, and regulatory compliance at your site.

9. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost production, downtime, damaged materials or workpieces, or loss of data, arising out of or related to the Site, these Terms, or any product, even if we were told such damages were possible.
  • Our total liability for any claim arising out of or related to the Site, these Terms, or any product is limited to the amount you paid us for the product that gave rise to the claim.

Some states do not allow certain limitations of liability, so some of the above may not apply to you.

10. Indemnity

You agree to defend, indemnify and hold harmless Alien Industrial Solutions and its owners, employees and agents from any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms or of any law, or your installation, use, operation or modification of any product, except to the extent caused by our own negligence or willful misconduct.

11. Intellectual property

All content on the Site, including text, graphics, logos, images, and the NowServingEarth and Alien Fab Lab names and marks, is owned by us or our licensors and is protected by intellectual property laws. Manufacturer names, logos and product names belong to their respective owners. You may not copy, reproduce, distribute or use Site content for commercial purposes without our written permission.

12. Governing law and venue

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms, the Site or any purchase must be brought in the state or federal courts located in or serving Bonneville County, Idaho, and you consent to the jurisdiction of those courts.

13. Other terms

  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
  • These Terms, together with our Shipping Policy, Refund & Returns Policy, Privacy Policy, and any written quote or order confirmation for your order, are the entire agreement between you and us about the Site and your purchase.

14. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on the Site and apply to orders placed after that date. The effective date at the top shows when these Terms were last updated.
